Massachusetts Taxing Information

The State Department of Revenue is charged with collecting taxes owed to the State. This means that if these taxes are delinquent, the DOR is authorized to use a variety of means to enforce their collection. Any form of contact from the DOR or related subdivisions should be responded to as promptly as possible. Failure to address a bill or associated correspondence can result in enforced collection actions.

Interest

Delinquent taxes are subject to interest, which can increase the total amount of your liability. The amount of interest may vary by the type and circumstances of the tax. Interest is not commonly subject to waiving, as the liability it is associated with must first be abated by the DOR.

Notice of Assessment

State attempts to collect on a delinquent tax bill begin with a Notice of Assessment. This Notice will outline the assessment date, the amount of the assessment, and any associated penalties or interest. Failure to address a Notice of Assessment will result in the issuance of a Demand for Payment.

Offer in Final Settlement

Under very particular circumstances, the DOR may accept the settlement of the liability for less than its full amount. This is rare and requires serious doubt as to the collectability of the full liability.

Priority One: Stopping Aggressive Enforced Collections

Payment Agreement

If you are unable to pay your liability in full, you may be able to make payment arrangements with the State. You may be required to provide a range of documentation, including financial statements, and will likely need to have all other tax returns and filings in order. Should you arrange a payment plan and fail to adhere to it, you may be subject to enforced collection actions.

Penalties

Should you fail to fully pay your tax bill or file your returns in time, you may be subject to additions to your total amount owed. These penalties vary by tax type and circumstance. It may be possible to have them waived if you can prove reasonable cause for your delinquency with evidence and appropriate documentation.

Representation

You may obtain representation from another individual at any point in dealings with the DOR. This is done through Power of Attorney and the completion of appropriate documentation and allows the DOR to discuss your case with the designated individual.

Seizure

In some cases, typically as a last resort, the State may seek to resolve tax liability by means of seizing real or personal property. You will be notified of any impending seizures shortly prior to the act. Seized property is sold at auction shortly thereafter.
